Below is a copy of the Indictment related to the former Wellcare employees. I was unaware when I first blogged about this case that one of the criminal defendants is Wellcare's former general counsel. What I find fascinating, as a lawyer, is that this is the second in-house general counsel of a major health care company to be recently indicted. Recall the current prosecution of former GSK in-house counsel Lauren Stevens.
Here is how Law.com reports on the story: "Thaddeus M.S. Bereday may have been general counsel at Wellcare Health Plans, Inc., but he isn't feeling so good these days. That's because he is due to appear Thursday in federal court to answer a criminal felony indictment. The U.S. attorney in Tampa, Fla., indicted Bereday, 45, and four other ousted Wellcare execs last Wednesday on multiple fraud counts. Bereday faces nine counts, including one count of conspiracy to defraud the U.S., four counts of making false statements, and four counts of health care fraud."
